For desperate for answers legal situation about third DUI and two year joint suspension?

my boyfriend got his third DUI back in august and is on felony probation. they took him to jail and set up another court date which was last week. well, the judge ended up talking him because she wanted his probation report and that takes a few weeks to get. This is third DUI in five years. before this case he took a two year joint suspension on a really stupid case. but now this is hanging over his head. he has been checking in with probation everytime he has too and he has a good job, and has proof of an appointment to be emrolled in his alochol cles. he didn't injure anybody in this car accident he damaged private property but a week after the accident he hired people to fix it without having to go through the court systems and we have proof of that. now my question is can he fight this two year joint suspension and just get county time and reinstated on probation? we live in southern california and i am sure u all have heard how crazy our legal system is. i read up on third time dui offenders and it said that the minimum is 120 days county jail time and no more then a year which we r hoping for. what do u all think?
